ARROYO GRANDE, Calif. - Susan Flores, the mother of Paul Flores, has been named as a defendant in a civil suit filed by the family of Kristin Smart.
Susan Flores, as well as her boyfriend, Mike McConville, are accused in the lawsuit of helping Ruben Flores remove Smart's body from Ruben's property in February 2020.
The lawsuit was filed in April and originally listed Ruben Flores as the defendant as well as two other defendants who were yet to be unnamed. At the time of the filing of the civil suit, James R. Murphy Jr., who is representing the Smart family, identified Susan Flores and McConville as the other two unnamed defendants.
At the time of the of the filing, the lawsuit made an explosive allegation that the three defendants removed the remains of Smart from Ruben Flores' Arroyo Grande home on or around Feb. 9, 2020, just a few short days after investigators searched the property.
The lawsuit alleges that the three "worked through the night, under the cover of darkness, to remove the remains of Kristin Smart to avoid having those remains at 710 White Court in the event of an additional search of the property." Murphy says a witness saw three people on the property the night of February 9.
"That person documented the activity of the night of February 9 photographically," Murphy said. "The photos are not great. The photos have been turned over to law enforcement. I've seen the photos and apparently Ruben, Susan and Mike were busy all night long under that deck."
The lawsuit aims to collect unspecified financial damages alleging the three guilty of malice, fraud and oppression.
Paul and Ruben Flores were arrested in mid-April as part of the decades-long investigation into the disappearance of Kristin Smart. Paul Flores is accused of killing Smart during an attempted rape at his dorm at Cal Poly in 1996. He is believed to be the last person to see Smart alive.
Paul Flores has been charged with first-degree murder. Ruben Flores has been charged as an accessory to the murder, accused of helping his son to conceal Smart's body. A court document released alleged that Smart's body was once buried in the backyard of Ruben Flores' home.
Murphy is hoping the threat of costly litigation puts pressure on McConville to tell authorities what he knows.
"Hopefully we're going to flush McConville out and he can save himself and give up the information he has on Ruben and Susan," Murphy said.
Ruben Flores was released from police custody after a judge agreed to reduce his bail amount. The two men have both pleaded not guilty to their charges. Mike McConville and Susan Flores have not been charged with a crime. We tried to reach them, but there was no answer at their door Monday afternoon.
